Agency Request Legislation: Dredge and Fill Permit Fees

The Supreme Court of the United States issued a ruling in May 2023 narrowing the definition of Waters of the United States to exclude many wetlands and other waters from regulated under the federal Clean Water Act. These waterbodies are still protected under the state Water Pollution Control Act. The Washington Department of Ecology is obligated to review and, where appropriate, provide an authorization for projects that propose to work in these and other waters of the state. To address the requirement to protect all state waters, the Department of Ecology is proposing agency request legislation to develop and implement a fee program to support a dredge and fill permit that provides a streamlined process for state review and regulation of non-federally regulated proposals with the potential to impact state waters.
