Chapter 173-424 WAC and WAC 173-455-150, Clean Fuel Standard Rulemaking, Informal Comments on CI Reduction Schedule
The Washington State Department of Ecology (Ecology) is in a rulemaking process to update the Clean Fuel Standard. The rulemaking will amend Chapter 173-424 WAC, Clean Fuels Program Rule and Section 150 of Chapter 173-455 WAC, clean fuels program fees.
This rulemaking will implement requirements from Second Substitute House Bill 1409 (SSHB 1409), which was signed into law on May 17, 2025. This bill increased the program's cumulative carbon intensity reduction goal to 45% below 2017 levels by 2038. While annual targets for years 2026 and 2027 were set in law, Ecology must set annual targets in rule for years 2028-2038 to meet that goal.
We've outlined options for rule changes to the carbon intensity reduction schedule in this informal paper, and invite you to submit informal written feedback on this topic.
